OFFICIAL RULES / USER AGREEMENT
These rules are effective starting at 1:00:00 PM Eastern Time (ET), on Wednesday January 1, 2014 and replace the rules that were in effect from Monday, November 4, 2013 at 1:00:00 PM ET through January 1, 2014 at 12:59:59 ET (the "Prior Rules"). On January 30, 2014, Section 2C of the rules was slightly modified to enhance the security of the game. On February 3, 2014, Section 4 of the rules was amended to clarify our policies regarding inactive accounts.
LuckyLabs' "Scantopia Promotion" also simply referred to in these rules as "Scantopia", "Game" or "Sweepstakes" is sponsored by LuckyLabs, Inc., located at 376 Boylston Street - #501, Boston, MA 02116 ("Sponsor").
NO PURCHASE NECESSARY. INTERNET ACCESS AND A VALID E-MAIL ADDRESS ARE REQUIRED. FOR THE BEST PLAYING EXPERIENCE, AN ANDROID MOBILE PHONE OR APPLE iPHONE IS HIGHLY RECOMMENDED. The game is not optimized for many pads and tablets. Although Sponsor strives to make the Scantopia user experience on iOS (Apple) and Android virtually identical there are times when one platform may have features and functionality that the other platform lacks.
ELIGIBILITY: To participate and claim cash prizes you must be a legal resident of the United States (including Puerto Rico, the District of Columbia, and the U.S. Territories) or Canada (except for the province of Quebec) and 13 years of age or older at time of registration.
IF YOU DO NOT MEET THE ELIGIBILITY REQUIREMENTS, YOU WILL NOT BE PREVENTED FROM PLAYING THE GAME, BUT YOU WILL NEVER BE ALLOWED TO CLAIM CASH PRIZES OTHER THAN TOKENS. YOU WILL ONLY BE ABLE TO RECEIVE AND USE TOKENS IN THE GAME. YOU WILL BE PLAYING THE GAME "JUST FOR FUN".
The brand images and brand names used in the Game do NOT imply brand sponsorship or affiliation. The brands that appear in the Game bear no liability or responsibility for the operation of the Game. Unless otherwise stated, players should assume that Scantopia and Lucky Labs, Inc. are not affiliated with any brand manufacturer.
Facebook, Twitter, Google/Android, Apple and the various mobile phone carriers such as Verizon, Sprint and AT&T are NOT affiliated with the Game or Lucky Labs, Inc. and bear no liability or responsibility for the operation of the Game.
Coupons.com, the source of the print-at-home coupons sometimes distributed as part of the Game is NOT affiliated with the Game or Lucky Labs, Inc. and bears no liability or responsibility for the operation of the Game.
PayPal, the sole means of payment for winners of valid cash prizes in Scantopia, is NOT affiliated with the Game or Lucky Labs, Inc. and bears no liability or responsibility for the operation of the Game. Players do not have to be members of PayPal to play, but must be willing to join PayPal to receive cash winnings. There is no cost to join PayPal, but PayPal membership does require one of the following: a credit card, a debit card, or a bank account (savings or checking).
All references to monetary amounts herein are in US Dollars (USD), whether or not expressly designated as such.
1. Promotion Period
The Promotion begins on Wednesday January 1, 2014 at 1:00:00 PM Eastern Time ("ET") and ends on Sunday, June 1, 2014 (the "Promotion Period") at 12:59:59 PM ET OR, at the Sponsor's sole option, when the sum of cash prizes paid to players via PayPal (as per Section 4) exceeds $8,000 (USD) as calculated by the Sponsor. Notice of such termination of the Game by Sponsor will be sent to all active, registered players via email. An active player is defined as a player who has logged-in to the app within the past 30 days.
Each "Game Day" begins at 1:00:00 PM ET and ends at 12:59:59 PM ET on the following calendar day of the Promotion Period.
Each "Game Week" begins at 1:00:00 PM ET on Monday and ends at 12:59:59 PM ET on the following Monday of the Promotion Period.
Each "Game Month" begins on the 1st of the month during the Promotions Period at 1:00:00 PM ET and ends on the 1st of the following calendar month at 12:59:59 PM ET.
The above notwithstanding, all entries into the Weird Sweepstakes and all cash balances and tokens earned by players under the Prior Rules are carried over into the Scantopia promotion that begins on Wednesday January 1, 2014.
The official timekeeping device of the Game is the computer system maintained by the Sponsor.
2. How to Play
Download the FREE Scantopia App ("Scantopia App") from the Google App Play Store, the iTunes App store or visit www.PlayScantopia.com ("Scantopia Website"*) or make use of links, banners and ads on other apps and other websites that lead to the Scantopia App or Scantopia Website.
* The website is maintained only for the convenience of players and does not have all of the features and functionality of the apps.
Players can scan bar codes and win tokens and cash prizes without formally registering. BUT, TO CLAIM ANY CASH PRIZES TO HAVE CASH-WINNINGS COUNT TOWARD THE $3 THRESHOLD REQUIRED FOR PAYMENT A PLAYER MUST REGISTER. (See Section 4 for a full explanation of The $3 Valid Payment Threshold and Method of Payment.)
For the avoidance of doubt, players who win cash prizes are prompted to formally register for the Game. Players who fail to register forfeit any right that they may have under any legal theory to cash prizes and whatever cash the player may have won is not counted toward the player's $3 Valid Payment Threshold and Sponsor will have no liability to player relative to same. Registration is a prerequisite to a player establishing any property right in cash prizes won in the Game.
THE TOKENS HAVE NO CASH VALUE. They have no intrinsic value and cannot be redeemed or exchanged for cash or prizes. They can, however, be used to accumulate entries into random drawings, where certain entrants, selected by chance, will receive prizes (See Section 3). Unless the Sponsor explicitly says otherwise, at the end of the Promotion Period the player's token balance is forfeited. No refunds will be granted.
Also, to receive the print-at-home coupons that are often delivered in conjunction with the Game, players must provide a valid email address because print-at-home coupons are delivered via email.
There are two (2) ways to register for Scantopia: 1) Through the Facebook registration process where an individual allows the Sponsor to collect relevant information from his/her Facebook profile; we will also ask the user for his/her country and, if the user's Facebook profile does not include an email address or Facebook does not return one, we will ask for the user's email address; or, 2) Through completion/submission of a registration form that requires email address, age, gender and country. As per Section 2B, players will be given a special incentive to register the locations of their homes ("Home Location") and allow Scantopia to know when players originate scans from their Home Locations. However, registering one's Home Location is NOT required for registration or Game play.
Upon claiming any cash prize, players may be asked for additional information including, but not limited to, street address and/or a digital photograph to be used by Sponsor primarily for verification purposes. Winners claiming cash prizes of $500 or more in a calendar year will be asked for a social security number or social insurance number (the later for Canadian winners) and, any player claiming $10 or more in winnings may be required to supply a digital photograph, complete an affidavit of eligibility and release of liability and release of publicity (where lawful). See Section 2F.
There is a limit of one (1) registered, unique email address per person/player and a given email address may only be registered once with Scantopia. Players sharing a device, whether it is a smartphone, pad, tablet or a PC, may be temporarily blocked from participating in the promotion and claiming prizes (cash or merchandise) until they provide sworn proof (a signed affidavit) that they are who they claim to be in the game. Failure to provide such proof in a timely manner will result in the termination of the player's account(s) and the forfeiture of any prizes the player may have won. To reduce the chance of being asked for proof of your identity (which the Sponsor can ask for from any player, anytime), IT IS HIGHLY RECOMMENDED THAT PLAYERS DO NOT SHARE DEVICES WHEN PLAYING SCANTOPIA. Additionally, each registered player must have a unique PayPal account to cash out. MULTIPLE PLAYERS ARE NOT PERMITTED TO CASH OUT TO THE SAME PAYPAL ACCOUNT.
THE BAR CODES PLAYERS SCAN MUST BE ON THE PHYSICAL PRODUCT, THE PRODUCT'S PACKAGING, OR FROM THE PRODUCT'S IN-STORE DISPLAY (BAR CODES ARE OFTEN INCLUDED AS PART OF A PRODUCT'S IN-STORE OR SO-CALLED "SHELF-EDGE" INFORMATION). PLAYERS WHO SCAN IMAGES OF BAR CODES OBTAINED FROM THE INTERNET, FROM PHOTOS, FROM COPIES OR FROM ANY SOURCE OTHER THAN THE PRODUCT ITSELF, THE PRODUCT'S PACKAGE, OR FROM THE PRODUCT'S IN-STORE DISPLAY ARE IN VIOLATION OF THESE OFFICIAL RULES AND MAY BE DISQUALIFIED FROM SCANTOPIA WHICH, AMONG OTHER THINGS, MEANS PLAYERS FOUND OR SUSPECTED OF MAKING ILLEGITIMATE SCANS (AS DETERMINED AT THE SPONSOR'S SOLE DISCRETION) MAY FORFEIT THEIR ACCRUED PRIZES (TOKENS AND OR CASH IN THEIR ACCOUNTS), MAY BE REQUIRED TO RETURN OR REPAY ANY CASH OR MERCHANDISE CLAIMED, AND MAY BE SUBJECT TO CIVIL AND/OR CRIMINAL PROSECUTION.
In case of a dispute over the identity of an entrant, the authorized account holder of the email address used to register for Scantopia will be deemed to be the entrant. "Authorized account holder" is defined as the person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address. Before awarding any cash prize, Sponsor reserves the right to require from the prize claimant satisfactory proof of being the authorized account holder; and, if such proof is deemed unsatisfactory by Sponsor in its sole discretion or if claimant fails to timely respond to such request for proof, cash prize will not be awarded and Sponsor will have no liability to player relative to same.
B. Special Registration Incentives
The first valid bar code scanned by a player will be rewarded with $1 toward the players $3 threshold (or, "The $3 Valid Payment Threshold", the point at which he or she can cash-out as per Section 4).
Registered players will also receive an additional $1 toward their $3 Valid Payment Threshold for adding their Home Location to their registration information (through the geo-location capability native in Android and other mobile devices and/or though the player's IP address) allowing Scantopia to recognize scans of products that are found in the location designated by the user as his/her home. Intentionally registering a location other than a residential location (e.g., a retail or commercial location) as your Home Location is a violation of these official rules and may result in disqualification and/or civil and criminal prosecution. Sponsor may ask you to confirm residency at your street address as part of the prize claiming/cash out process; and, if Sponsor determines in its sole discretion that such confirmation is inadequate in any respect, or if you fail to timely comply with Sponsor's request, Sponsor may refuse to honor your prize claim/cash out request, in whole or in part, without liability.
Scans made from a properly registered Home Location ("Home Location Scans") are eligible to receive elevated rewards in the Scan & Win game (See Section 3, Prizes/Odds of Winning).
HOME LOCATION REGISTRATION MAY BE REQUIRED TO PLAY AND WIN CERTAIN GAMES WITHIN SCANTOPIA (SEE SECTION 2C).
While players are permitted to change their Home Locations, abuse of this feature, as determined at the Sponsor's sole discretion, my result in the temporary suspension or permanent revocation of the player's account including forfeiture of any prizes won or pending.
C. Three (3) Ways to Play and Win
Scantopia consists of three (3) different, but interrelated games:
Scan & Win
Scan & Win is the centerpiece game of Scantopia. In Scan & Win players scan bar codes to win cash and tokens. When a registered player accumulates $3 or more in winnings, the win becomes eligible for payment meaning the player can use the app's "Cash Out" feature to receive his/her cash winnings. WINNINGS IN A PLAYERS ACCOUNT UNDER $3 ARE NEVER PAYABLE AND A REGISTERED PLAYER HAS NO RIGHT TO CASH UNLESS AND UNTIL WINNINGS REACH THE $3 THRESHOLD. See Section 4 for a full explanation of the $3 Valid Payment Threshold and Method of Payment.
Every player is initially allocated a minimum of at least 12 scans (the Sponsor can, at its sole discretion, chose to allocate players more than 12 scans). When the player's allotment of scans is depleted, the player has a zero (0) balance of scans but can earn more scans (or, "Energy") by waiting at least one half-hour (30 minutes) before engaging in any further scanning activity. So, for example, a player using 2 scans can wait one half-hour and, by so doing, 1 unit of Energy (equal to 1 scan) is restored to her balance of scans. If she waits one full hour she would be restored to her full balance of scans. Units of Energy are available only if a player waits a full one half-hour period. Sponsor will not round up units of Energy if a player waits less than a full one half-hour period before scanning again. For example, a person waiting forty-five (45) minutes before scanning again will receive 1 unit of Energy (not 2 units of Energy).
Players also earn Energy by sending Energy to friends and/or by asking for Energy from others as a gift. Players do this via Facebook, Twitter, or email.
You can only send Energy to or receive Energy from other registered users of the Scantopia app, although you can send requests to people who are not yet users, and they will have the option to install the Scantopia app (and, thereafter, you can receive Energy from them). For the avoidance of doubt, unless and until invited persons become registered users of the Scantopia app, you will not receive Energy in conjunction with sending requests to them.
Generally if you are sent a gift from a player, you will have the option to send them a gift back. Players are limited to "harvesting" two (2) units of Energy per registered user per day (so, for example, if you ask for a gift and get one back, and if you send a gift and receive one back you will have harvested the maximum of 2 units of energy from that registered user).
IT MUST ALWAYS BE THE CASE THAT THE SENDING AND GIFTING OF ENERGY IS BY AND BETWEEN REAL PEOPLE WHO ARE PROPERLY REGISTERED FOR THE GAME AND ACTING IN FULL COMPLIANCE WITH THESE OFFICIAL RULES. USE OF ANY APPARATUS OR DEVICE TO SEND/GIVE ENERGY (E.G., USE OF FAKE ACCOUNTS) IS CAUSE FOR DISQUALIFICATION FROM THE SWEEPSTAKES, FORFEITURE OF ALL CASH AND/OR TOKENS IN ONE'S SCANTOPIA ACCOUNT(S) AND MAY ALSO RESULT IN CRIMINAL AND/OR CIVIL PROSECUTION.
A GIVEN PRODUCT (OR STOCK KEEPING UNIT, ALSO KNOWN AS A SKU) CAN ONLY BE SCANNED ONCE PER GAME DAY. SO, FOR EXAMPLE, A PLAYER CAN SCAN A 2-LITER BOTTLE OF DIET COKE ONLY ONCE PER GAME DAY. HOWEVER, IT WOULD BE ACCEPTABLE FOR THE SAME PLAYER TO ALSO SCAN A 12 FLUID OUNCE CAN OF DIET COKE (THE 12 FLUID OUNCE CAN IS A SEPARATE SKU, WITH A SEPARATE AND DISTINCT BAR CODE) DURING THE SAME GAME DAY. THE DETERMINATION AND/OR ACCEPTANCE OF A SKU AS A QUALIFIED, VALID SCAN IS AT THE SOLE DISCRETION OF THE SPONSOR.
Daily Super Scan
Every Game Day during the Promotion Period at least one Daily Super Scan product is revealed at 1:00 PM ET on the Scantopia App. Other Daily Scans may be announced throughout the Game Day.
The Daily Super Scan specifies a product or family of products, a number of available scans, and an associated prize for each successful scan. Unlike the Scan & Win game, every valid scan – every scan that takes place before an allotted number of scans is reached – will be rewarded with a cash prize that counts toward the player's $3 Valid Payment Threshold. Scans made after the allotted number of scans is exhausted receive no reward.
As an example, a Daily Super Scan might read: "The first 100 players who scan any eligible French's Mustard product will receive $1." The number of players who can win may vary, the specificity of the product may vary (for example, any French's Mustard versus a very specific 8-ounce squeeze bottle of French's Mustard) and the value of the prize may vary, but in no case shall the prize value be less than 5-cents (USD $.05) per valid scan. These important details are always available to players in the copy that describes every Daily Super Scan.
Players are only allowed to scan each featured Daily Super Scan product one (1) time on the Game Day that the Super Scan product is announced.
The Sponsor can, at its sole discretion, reveal the upcoming Super Scan product(s) before 1:00PM ET on a given Game Day on/through one or more third-party affiliated websites, apps or social media including the Sponsor's own social media. But even when a Super Scan is announced earlier than 1PM ET it will not, unless otherwise stated, be accepted by the app until 1PM ET or later in the Game Day.
The Sponsor, at its sole discretion can also choose to create one or more separate Daily Super Scan(s) available only through affiliated, third-party websites, apps or social media ("Affiliate Super Scan") and/or through the Sponsor's own social media. Any Affiliate Super Scan and/or Super Scan announced on/through the Sponsor's social media will also be revealed at, or after, 1:00 PM ET on a given Game Day.
UNLESS OTHERWISE STATED, DAILY SUPER SCANS ONLY COUNT WHEN THEY ARE MADE FROM THE PLAYER'S REGISTERED HOME LOCATION. IN ALL CASES, PERSONS WHO CHOOSE NOT TO INCLUDE THEIR HOME LOCATION AS PART OF THEIR SCANTOPIA REGISTRATION ARE NOT ELIGIBLE TO PARTICIPATE OR WIN PRIZES IN THE DAILY SUPER SCAN GAME
The valid scans in the Daily Super Scan are tracked by the Sponsors system and the tracking number displayed to the players is only an estimate and, as such, is not binding on Sponsor. Ultimate determination of the number of scans available for a given Daily Super Scans is at the sole discretion of the Sponsor. Accordingly, it is possible that the tracking number displayed may not correlate to the prizewinners in a given Daily Super Scan Game. EVEN IF THE TRACKING NUMBER INDICATES THAT YOUR SCAN IS ONE (1) OF THE VALID SCANS, YOU MAY NOT BE A PRIZEWINNER IN THAT DAY'S DAILY SUPER SCAN GAME.
When the allotment of winning scans has been exhausted for a given Daily Super Scan product, players will be notified that no more scans remain for that featured product for that Game Day. Players can choose to scan (and winners can choose to re-scan) any Daily Super Scan product as part of the Scan & Win game. The two games are not linked; a scan in the Daily Super Scan game does not count as a scan in Scan & Win game and vice versa. Players who Sponsor determines in its sole discretion scan a valid Daily Super Scan product before the allotment of valid scans is exhausted are winners in that day's Daily Super Scan Game, but the first player to scan after the allotment of scans is exhausted – and all subsequent players who attempt to scan the featured product – will not be awarded a prize.
THE ACCEPTANCE OF A SCAN AS A VALID REPRESENTATION OF THE PRODUCT OR PRODUCTS FEATURED IN THE DAILY SUPER SCAN IS AT THE SOLE DISCRETION OF THE SPONSOR. IF, FOR EXAMPLE, THE DAILY SUPER SCAN SPECIFICALLY INSTRUCTS PLAYERS TO SCAN A 15.5-OUNCE BOX OF CHEERIOS AND THE PLAYER SCANS AN 18-OUNCE BOX OF CHEERIOS, THE 18-OUNCE BOX WILL BE REJECTED. SIMILARLY, IF THE DAILY SUPER SCAN INSTRUCTS THE PLAYER TO SCAN ANY CHEERIOS (A "PRODUCT FAMILY") THEN MOST BUT LIKELY NOT ALL SIZES AND FLAVORS OF CHEERIOS WILL BE ACCEPTED. FOR MANY PRODUCTS AVAILABLE FOR CONSUMER PURCHASE THERE MAY BE HUNDREDS OF SKUS (DIFFERENT SIZES AND/OR FLAVORS WITH DISTINCT BAR CODES; E.G., HONEY NUT CHEERIOS AND APPLE CINNAMON CHEERIOS IN VARIOUS SIZES) AND, GIVEN THE 30-PLUS YEAR HISTORY OF BAR CODES -- NOT TO MENTION MINOR PRODUCT VARIATIONS ACROSS THE GLOBE IT IS NEARLY IMPOSSIBLE FOR SPONSOR (OR ANY OTHER ENTITY) TO DEFINITIVELY CATALOG ALL THE SKUS IN A PRODUCT FAMILY. THE AFOREMENTIONED NOTWITHSTANDING, SCANTOPIA WILL USE COMMERCIALLY REASONABLE EFFORTS TO INCLUDE THE MOST POPULAR SKUS IN ANY DAILY SUPER SCAN THAT ALLOWS THE PLAYER TO SCAN ANY MEMBERS OF A PARTICULAR PRODUCT FAMILY AND SPONSOR DISCLAIMS ANY LIABILITY IN CONJUNCTION WITH A REJECTED SCAN UNDER SUCH CIRCUMSTANCES.
Weekly Progressive Jackpot
Each and every valid scan in the Scan & Win game adds at least one one-hundredth of a penny (USD $.0001) to a Weekly Progressive Jackpot up to a maximum total of $1,000 per Game Week. The weekly jackpot starts at and will never be less than $10 (ten-dollars) regardless of the totals accumulated during a given Game Week. The final amount of the pot for a given weekly progressive jackpot is determined by the Sponsor's system (as implemented by Sponsor in its sole discretion) and may differ from the amount displayed on the Scantopia App and/or Scantopia Website. Sponsor disclaims any liability in conjunction with the difference between the final amount of the pot for a given weekly progressive jackpot and the amount displayed on the Scantopia App and/or Scantopia Website.
To enter the drawing for the Weekly Progressive Jackpot, players exchange tokens for entries. Players earn tokens in the Scan & Win game (as described above, in Section 2C.)
Players can earn additional entries into the Weekly Progressive Jackpot whenever they share news of specific in-game activities via Facebook, Twitter or email. The activities players can share to earn additional entries into the Weekly Progressive Jackpot are:
1. Winning a Daily Super Scan
2. Winning in Scan & Win
3. Entering into the Weekly Progressive Jackpot; and/or
4. Entering into one or more of the Weird Sweepstakes
Players earn 1 additional entry for each medium on which they share regardless of how many people they share with. So, for the avoidance of doubt, a share on Facebook will result in 1 additional entry whether the player shares it with one Friend or several Friends. But, the same player can earn one (1) additional entry for posting a Tweet about a specific in-game activity, irrespective of the number of Twitter followers he/she has, and still another additional entry by sharing via email (regardless of the number of persons to whom he/she sends the email).
Players can also earn 1 additional entry for making Friends aware of the app using the Facebook invite feature and/or email. For the avoidance of doubt, the invited Friend does NOT have to register for or visit the Scantopia app for the player to receive the entry. Entries are awarded at the rate of 1 entry per Facebook friend invited, on a one-time basis, and 1 entry per friend emailed, on a one-time basis. For the avoidance of doubt, if you invite Jane Doe once using Facebook you cannot invite Jane Doe again using Facebook. Players also get one additional entry for each Tweet posted inviting their Twitter followers to download and use the app. Players are limited to one such Tweet per day.
AT THE SPONSOR'S SOLE DISCRETION, SPONSOR CAN LIMIT THE NUMBER OF PROGRESSIVE SWEEPSTAKES ENTRIES PLAYERS ARE ALLOWED TO EARN EMPLOYING THE ABOVE DESCRIED METHODS. SUCH LIMITS ARE MADE KNOWN TO PLAYERS AS THEY ARE ACHIEVED IN THE GAME.
The number of total entries per player is tracked by the Sponsors system and is displayed to the player. This number may not be current at all times, and Sponsor reserves the right to adjust the number of entries accrued by a player at any time without liability of any kind.
Entries received for one Weekly Progressive Jackpot drawing will NOT be retained for subsequent Weekly Progressive Jackpot drawings or for any other Scantopia drawing.
In this game, players exchange tokens for entries into four (4) or more separate monthly drawings for fun, offbeat prizes. There will be a minimum of 24 such drawings during the Sweepstakes Period. Details for each month's Weird Sweepstakes will be posted as the specifics, including the ARV of each, are determined. Such future monthly drawings will be posted at least 3 days before players can enter them using the Scantopia App or Scantopia Website.** The number of times a player may enter a given monthly drawing are limited only by his/her supply of tokens (players exchange one (1) token for one (1) entry). But, an entrant may only exchange a token for one (1) entry in one (1) of the monthly drawings. At the winner's option, and subject to the limitations in Section 4, the prize can be exchanged for a cash payment equivalent to the prizes' listed ARV.
**Such postings are made a part of these Official Rules and incorporated herein by reference. In the event of any inconsistency between such postings and these Official Rules, these Official Rules shall govern, prevail and control with the sole exception of the specific details of the applicable monthly drawing (regarding which the posting shall govern, prevail and control).
January 2014 - Weird Sweeps
The winner of this drawing will receive an assortment of Kettle Brand chips with an Approximate Retail Value of $100, plus a Universal Remote Control with an Approximate Retail Value of $30 for a total prize package with and ARV of $130. Sponsor will use commercially reasonable efforts to honor the winner's chip flavor preferences. Ultimate composition and all other aspects of the prize are at the Sponsor's sole discretion. Winner may receive the prize via a number of separate shipments.

The failure of Sponsor to enforce any provision does not constitute the waiver of such provision.
E. Limitations on Bar Code Recognition
Scantopia recognizes most 12-digit UPC-A bar codes (Universal Product Codes) commonly found on branded consumer-packaged goods sold in supermarkets, convenience stores and pharmacies. As a rule of thumb, if the product is universal if it is sold by many different retailers Scantopia generally should be able to recognize it.
The Game may, at times, recognize less used/less common UPC-E, UPC-B, UPC-D and EAN-13 bar codes.The Game currently will not recognize GS1-Databars (increasingly used on coupons and some products), QR codes, Aztec Bar Codes, or other non-GS1-based product codes. The Game will most often not recognize bar codes on store-branded products or on products sold at specialty retailers such as Trader Joes. Nor will Scantopia recognize the PLU (Price Look-Up) codes (typically 8-digit codes) used by stores to track/scan produce, meat, milk, and other bulk or so-called random weight items.
When the Game does not recognize a bar code it will either reject the bar code outright or ask the player for additional information about the product. THE ACCEPTANCE OF ANY SCANNED BAR CODE AS A VALID PLAY IN SCANTOPIA IS AT THE SOLE DISCRETION OF THE SPONSOR.
F. Payment Caps
In the interest of preventing fraudulent play, players who meet any one of the following conditions may be barred from claiming a prize and/or cashing out until they contact the Sponsor's Customer Service Department and provide information that may include, but is not limited to, proof of age, email address, street address (and proof of occupancy), a digital photo, an affidavit, and/or social security number or social insurance number (as applicable).
1. Any player who wins $10 or more in a single scan or drawing;
2. Any player who attempts to cash out a Valid Payment Threshold of $3 more than once per day;
3. Any player who has claimed $500 or more in prizes.
Players complying with the information request from Sponsors Customer Service (as determined by Sponsor in its sole discretion) will be promptly returned to a status that allows them to cash-out. Players are notified of their need to contact Sponsor's Customer Service Department via pop-up messages presented in the Scantopia App.
Please note, as per Canadian law, Canadian residents must provide the correct answer to a mathematical skill-testing question within a given time limit without assistance of any kind every time they wish to cash out. All payments are made in US dollars (USD).
3. Prizes/Odds of Winning
Scan & Win is an "Instant Win" game that draws upon a prize pool of up to $1,080.50 per day. In the Scan & Win game, every valid scan (See Section 2C) results in winning a cash prize or tokens.
The Weekly Progressive Jackpot and Weird Sweepstakes are, respectively, weekly and monthly drawings where the odds of winning are based on the number of valid entries received for each applicable drawing.
The Daily Super Scan is a game where players who scan a featured product before a maximum threshold of scans for that featured product is achieved receive the specified cash reward. But once the threshold is reached, no more prizes are awarded.
Print-at-home coupons (and other such offers) are often handed out with tokens and cash prizes. They are not counted in the prize pool and are presented as a form of advertising. The distribution of coupons and offers is at the sole discretion of the Sponsor.
Scan & Win Prizes/Odds
The odds of winning cash or tokens in the Scan & Win game are detailed in the table below. For clarity, each valid scan initiates a virtual "spin of a wheel" subject to the listed probabilities. So, for example, there is a 13.5 percent chance of the player winning 5-cents (5¢ or $.05). In the unlikely event that a player "spins" and wins the 5-cent prize, but none of the seventeen thousand six hundred and ten (17,610) 5-cent prizes are left for the "Game Day" then the player will receive the amount of tokens listed in the "Token Fallback" column (which, in the 5-cent prize example, is five tokens). But, if the designated quantity of cash prizes has not been exhausted, the "Token Fallback" column is of no effect.
For clarity, once one unit of a given denomination of cash prize is won, that unit is removed from the daily allotment of that denomination of cash prize. So, in our example, a player who wins a nickel (5) from the pool of 17,610 nickels per day depletes that day's pool by one nickel (5) such that 17,609 nickels remain to be won.
The minimum odds of winning a cash prize are 3 percent. At the Sponsor's option, the overall odds of winning a cash prize can be made MORE FAVORABLE, BUT NEVER LESS FAVORABLE to players. For clarity, Sponsor can change the odds associated with any given cash prize listed in the table so long as the overall odds of winning cash remain unchanged or become more favorable to players than 3 percent.
Please note all token wins are doubled for Home Location Scans.
Daily Super Scan
Players who scan an announced Daily Super Scan product before the stated maximum number of scans for that featured product is achieved will receive the specified cash reward.
So, for example, a Daily Super Scan might read: "The first 100 players who scan any eligible French's Mustard product will receive $1." In this example, the first 100 players who scan French's Mustard, will receive $1 toward their $3 valid payment threshold, but the 101st player to scan French's Mustard will not receive a prize. For clarity, the number of players who can win may vary, the specificity of the product may vary (for example, any French's Mustard versus a very specific 8-ounce squeeze bottle of French's Mustard) and the value of the prize may vary, but in no case shall the prize value be less than 5-cents (USD $.05). These important details are always available to players in the copy that describes every Daily Super Scan.
The valid scans are tracked by the Sponsors system and the tracking number displayed to the players is only a best estimate and is not binding upon Sponsor, with Sponsor having no liability with regard to same. Ultimate determination of the number of valid scans in a Daily Super Scan Game is at the sole discretion of the Sponsor.
Weekly Progressive Jackpot
Each and every valid scan in the Scan & Win game adds at least one one-hundredth of a penny (USD $.0001) to a Weekly Progressive Jackpot that starts with a $10 pot and can grow up to a maximum total of $1,000 per Game Week.
The winner of the Weekly Progressive Jackpot is determined by a random drawing at the conclusion of each Game Week during the Promotion Period. A player's odds of winning the weekly drawing depend on two factors: 1) the number of valid entries accrued by a given player; and, 2) the total number of valid entries accrued by all players. So, for example, a player holding 100 entries out of 10,000 total entries would have a 1-in-100 (1%) chance of winning the weekly jackpot, which, in this example, would be worth $60 (10,000 scans adds $50 to the initial $10 pot).
During each Game Month there will be at least four (4) Weird Sweepstakes (that is, at least 4 separate monthly drawings for fun, offbeat prizes). The winner of any given Weird Sweepstakes is determined by a random drawing at the conclusion of each Game Month during the Promotion Period. A player's odds of winning a given drawing depend on two factors: 1) the number of valid entries accrued by a given player and used by that player to enter a particular monthly drawing; and, 2) the total number of valid entries accrued by all players and used by all players to enter a particular monthly drawing. So, for example, a player holding 50 entries out of 5,000 total entries would have a 1-in-100 (1 percent) chance of winning the prize.
A player can only win one Weird Sweepstakes or one Progressive Jackpot in a Game Month. On days when winners for both types of drawings are determined, the Progressive Jackpot winner is determined first.
In the Weekly Progressive Jackpot and Weird Sweepstakes drawings, if the winner initially picked does not claim has/her prize within 14 days of notification by Sponsor, alternate winner(s) will be selected from the pool of remaining eligible entrants for that specific weekly or monthly drawing (as applicable) until the prize is claimed.
4. Valid Payment Thresholds, Payment Method and Inactive Accounts
A player's cash winnings are tracked in an account maintained by Scantopia whose system is the sole and ultimate determinant of a player's performance in Scantopia. THE TOKENS HAVE NO CASH VALUE. They have no intrinsic value and cannot be redeemed or exchanged for cash or converted (directly or indirectly) into cash or prizes.
A REGISTERED PLAYER HAS NO RIGHT TO RECEIVE CASH UNLESS THAT PLAYER'S ACCOUNT CONTAINS AT LEAST $3 IN WINNINGS. UNDER NO CIRCUMSTANCES ARE WINNINGS PAYABLE IF THE PLAYERS BALANCE IS LESS THAN $3. BALANCES OVER $3 ARE PAYABLE ONLY UPON REQUEST AND ONLY IN WHOLE DOLLAR INCREMENTS.
The following examples are offered for the sake of clarity. A player with a $4 balance in her account will be eligible to redeem $4 in cash winnings because $4 is above the $3 Valid Payment Threshold. A player with $2.99 in his account cannot claim any cash prize. A player with $3.01 in her account can cash-out $3 and will have $.01 left in her account. In this case, she would need to win an additional $2.99 to be eligible to cash-out again. Similarly, a player with $3.99 in his account can cash-out $3 and will have $.99 left in her account. In this last case, she would need to win an additional $2.01 to be eligible to cash-out again.
Players begin the process of redeeming winnings by clicking on the "Cash-Out" button in the Scantopia App. NO PAYMENTS ARE MADE UNLESS THEY ARE REQUESTED THROUGH THIS PROCESS.
Any player, regardless of the amount of money in his/her account, who has not logged in to Scantopia for a period of 30 days is deemed to be inactive (an "Inactive Player"). Inactive Players will be sent at least one notification via email reminding them to login on or about the thirtieth (30th) day of inactivity. An Inactive Player who does not login within 14 days of receiving such notification will have his/her account balance reset to zero ($0.00).
Players acknowledge that the Game is only available for a limited time. At the end of the Promotion Period, all players with less than $3 in winnings will forfeit their balances unless otherwise required by law or unless the Sponsor publishes a decision to "rollover" player balances into a new game. Players agree (upon Sponsor's request and without compensation) to sign all necessary and appropriate documentation so as to confirm such intention. Such balances will not be refunded.
At the end of the Promotion Period, all players with winnings of $3 or more will be notified with messages in the Scantopia App and/or via email. Such players will have 14 days from the end of the Promotion Period (i.e., from June 1, 2014) to request payment using the Cash-Out button and/or other specified method to claim winnings. If such payment is not requested before the 14 day grace period, players will forfeit their balances and will have no right to cash winnings, unless otherwise required by law or unless the Sponsor publishes a decision to "rollover" player balances into a new game. Players agree (upon Sponsor's request and without compensation) to sign all necessary and appropriate documentation so as to confirm such intention.
ALL PAYMENTS ARE MADE THROUGH PAYPAL. THERE IS NO ALTERNATIVE WAY FOR SCANTOPIA WINNERS TO BE PAID. OPENING A PAYPAL ACCOUNT IS FREE BUT REQUIRES INTERNET ACCESS, AN EMAIL ADDRESS AND ONE (1) OF THE FOLLOWING: A CREDIT CARD, A DEBIT CARD, OR A BANK ACCOUNT (SAVINGS OR CHECKING). ALL PAYMENTS ARE MADE IN U.S. DOLLARS (USD).
For simple, fast payment, players who have PayPal accounts are encouraged to register for the Game and claim winnings with the email address they used to join PayPal. The player will receive an email from PayPal explaining that money is waiting to be received.
Players who do not have PayPal accounts can still easily receive payment through PayPal. In this scenario, Scantopia sends payment to PayPal using the email address the player supplied to Scantopia. PayPal then sends the player an email explaining that money has been sent to the player and, in order to receive it, the player must register that email address for a PayPal account.
Regardless of whether a player is or is not registered with PayPal, payments sent to PayPal that are unclaimed by winners after 30 days of attempted delivery are declared void and are forfeited by the winner. For the avoidance of doubt, winnings unclaimed after 30 days cannot be claimed and the Sponsor will have no liability to player relative to same.
Winners claiming cash prizes of $500 or more in a calendar year will be asked for a social security number or social insurance number (the equivalent of a social security number in Canada) and, any player claiming $10 or more in winnings in a single prize may be required to supply a digital photograph, and complete an affidavit of eligibility and release of liability and release of publicity (where lawful). See also Section 2F for additional limitations that can be placed on a player's cash winnings.
5. Eligibility and Other Conditions of Participation
Employees, officers, directors and production personnel of the Sponsor and its subsidiaries, divisions or affiliates, as well as any other entities involved in any manner with the development, production and implementation of the Scantopia Promotion (all such individuals and entities collectively referred to as "Sweepstakes Entities") and each of their immediate family members (defined as parents, children, siblings and spouse, regardless of where they live), or those living in the same household as any of the individuals in the preceding categories whether or not related thereto are NOT eligible to participate in the Promotion/Sweepstakes.
Potential winners particularly those who win $1,000 or more may be required to sign and return an Affidavit of Eligibility, a Liability Release and a Publicity Release (where legal) within fourteen (14) days of date of prize notification. In the event of noncompliance, or if potential winner cannot be contacted for any reason, prize will be forfeited, without compensation of any kind.
All cash prizes will be awarded through PayPal. Each winner shall be solely responsible for all federal, state, and/or local taxes on prize(s) and the value of prize(s) won by such person in the Promotion will be reported to applicable governmental authorities via an IRS 1099 Tax Form (for U.S. residents) and/or other applicable documentation. Canadian residents may be responsible for foreign withholding tax. In all cases, as a condition to receipt of prize, winner agrees to fully cooperate with Sponsor so that it may fulfill its tax reporting obligations to all applicable government authorities. All unspecified expenses in conjunction with acceptance or use of prize(s) are the winners sole responsibility. No prize substitution except as specified in Section 2C under Weird Sweepstakes. No prize transfer.
Except where prohibited by law, by accepting prize, the winner grants to Sponsor and its designees, the right to use his/her first name, last initial, city and state/province, likeness, photograph, voice and other indicia of persona in any and all media for advertising, trade and promotional purposes, without notification or additional compensation of any kind.
By registering for and participating in the Promotion, a person indemnifies, releases and agrees to hold harmless the Indemnitees from any and all liability arising from participating in the Promotion, any Promotion/Sweepstakes-related activity and/or acceptance, receipt, possession or use/misuse of any prize.
By registering for and participating in the Promotion, a person agrees to the decisions of Sponsor, which are final and binding in all respects and not subject to appeal.
If any provision of these Official Rules is determined by a court of competent jurisdiction to be illegal, invalid or unenforceable, such provision shall be replaced with another provision that is legal, valid and enforceable and most closely approximates the original intention of Sponsor. The illegality/invalidity/unenforceability of a given provision will not affect the legality/validity/enforceability of any other provision or the legality/validity/enforceability of the balance of these Official Rules.
FORCE MAJEURE. If, for any reason, the Promotion/Sweepstakes (or any part thereof) is not capable of running as planned by reason of infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, fire, flood, storm or other natural cataclysm, riot, strike, civil commotion, terrorist act (or threat of terrorist act), governmental regulation or any other causes beyond the control of Sponsor which, in the sole opinion of Sponsor, could or does corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes (or any part thereof), Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes and/or conduct the Sweepstakes and select prize winners in a manner which is fair, equitable and in accordance with these Official Rules, as determined in Sponsor's sole discretion. And, notice of such action by Sponsor will be posted on the Scantopia App and the Scantopia Website.
This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, PayPal, Coupons.com, Google, Apple, Twitter or any of the brands featured in the Game.
7. DISPUTES & CONTROLLING LANGUAGE
To the fullest extent permitted by law, by registering for and participating in the Promotion/Sweepstakes, you agree that: (a) any action at law or in equity arising out of or relating to these Official Rules or the rights and obligations of any entrant/registrant and/or Sponsor shall be filed in the (US) federal or state courts situated in Boston, Massachusetts and you hereby consent and submit to the personal and exclusive jurisdiction of such courts for the purposes of litigating any such action (and waive any right to change of venue, forum non conveniens, or any like right); (b) any and all disputes, claims, and causes of action arising out of or connected with these Official Rules, and/or the rights and obligations of any entrant/registrant and/or Sponsor, shall be resolved individually, without resort to any form of class action, and (c) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred (if any), including costs associated with registering for and/or participating in this Sweepstakes but in no event attorneys' fees; and (d) under no circumstances will any entrant/registrant be permitted to obtain awards for and hereby waives all rights to claim punitive, exemplary, special, incidental, indirect and consequential damages and any other damages (whether due to negligence or otherwise), other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
